After you sustain a personal injury loss of any nature settlement of your claim is paramount to you. Prior to settlement, your doctors have to certify that you have attained a maximum medical improvement MMI. That means your condition cannot improve any further. Different people recover differently but typically, most people recover between 18 months to 2 years from the date of initial injury. Proper case management is vital to the evaluation of your damages and loss. A correct prognosis to ascertain your future medical needs typically takes about 2 years after the original injury. After that, your case can then progress to either trial or settlement one year later.
Statutory Accident Benefits Schedule (SABS)
Once you suffer a personal injury loss, you are entitled to certain benefits under your Ontario motor vehicle insurance policy. We can set up your claim with the insurance company under SABS. These benefits fund a wide variety of your needs and services including medical treatment and rehabilitation costs. Most of these services will not be covered by OHIP or other disability insurance plans.

There are no upfront fees because we only charge fees on a contingency basis. When we settle your accident benefits claim or lawsuit, we accept a percentage of your recovery as our lawyer’s fees. We only bill for fees and disbursements in the event we succeed on your behalf. This percentage will depend on several factors, such as the amount of time we spend on your case, whether we had to give up other lucrative retainers due to the time we spend on your case, the complexity of the case and the risk we assume by accepting your case on contingency.

Some of the Accident Benefits under SABS
Income replacement helps pay an employed or self-employed person who can no longer work due to an accident. It can pay 80% of your net loss of income up to a maximum of $400.00 per week. The balance can be claimed when we file a lawsuit in the tort portion of the claim. Short term and/or long term disability benefits may also apply if you have some workplace private or a group insurance policy.
Attendant care costs help pay for someone to look after a seriously hurt person.
Non-earner benefits of $185.00 per week is payable beginning six months after the accident, if an employed or self-employed person can no longer carry on normal activity due to the accident. A claimant must however be at least 16 years old to receive non-earner benefits.
A child’s caregiver, stay-at-home parent or other caregiver may get benefits of $250.00 per week if they are unable to continue providing care after the accident.
A student who is unable to return to school is eligible for a lost educational expense not to exceed $15,000.00. This covers expenses incurred before the accident for tuition, books, equipment or room and board.
Funeral expenses and death benefits are paid as a result of a fatal accident. The repair or replacement of personal property damaged in an accident, and the expenses of visitors who come to see you because of the accident may all be payable.
You are further entitled to receive benefits from the accident benefit insurance company or the Motor Vehicle Accident Claims Fund.
Finally about two year after your personal injury loss, we will file a lawsuit on your behalf against the at-fault-driver in the accident. This is called the tort portion of the claim.
